Welcome to the E-Smart APP and the energy management system (EMS) from
M-TEC.
Please read the following terms and conditions carefully. If you do not agree with any of these terms, you may choose not to use M-TEC’s software and services. You will be deemed to have accepted the contents of this Agreement and Policy if you use the E-Smart APP and the M-TEC Energy Management System.
The E-Smart APP in combination with the M-TEC energy management system is the smart solution for managing the E-SMART modular system for holistic management of renewable energy. Specially developed by M-TEC, it enables users to control and monitor their M-TEC devices (recording, managing and displaying all integrated devices and analysed data).

Registration
After installing the E-Smart APP, the user registers with the following data:
- First name
- Surname
- E-mail address
- Address Location (street, postcode, country)
- Language
- Currency
- Date of birth
- Telephone number
- Serial number(s) of the installed devices
A password is also required to create the customer account. After registering the account, the user is required to keep the password safe in order to prevent this password from being passed on to unauthorised third parties. User accounts can be deleted. If you wish to delete your user account, please contact M-TEC customer service. A corresponding request will be processed as quickly as possible. For customer accounts created by the dealer or installer, please reset the password the first time you log in to secure the account. The end user is the owner of the appliance and their dealer/installer is responsible for its maintenance. This should be communicated to the owner when connecting an appliance. After obtaining the express consent of the device owner, the dealer/installer can be granted access to the device to the authorised extent. For example, the dealer/installer will have a device and system management function after obtaining the owner’s consent.
Restrictions on Use
The E-Smart APP provided for use and the M-TEC energy management system were developed by M-TEC and are protected by copyright. M-TEC reserves all rights of use, in particular the right of distribution. The user may only use and utilise the information and results of the online offer within the scope of the terms of use. The user may only process this information for personal use. Any other use of the information and results obtained from this service is only permitted with the express written consent of M-TEC.

The user has no claim to the availability of the E-Smart APP or the M-TEC energy management system or to 100% data availability. All information, content, materials and services made available to you are provided by M-TEC on an „as is“ basis, unless otherwise specified in a separate agreement. M-TEC makes no representations or warranties of any kind, express or implied, as to the operation of the E-Smart APP or the M-TEC Energy Management System or the information, content, materials, products (including software) or services included therein or otherwise made available to you through the M-TEC Energy Management System, unless otherwise specified in writing. You expressly agree that your use of the E-Smart APP and the M-TEC Energy Management System is at your sole risk. To the maximum extent permitted by applicable law, M-TEC disclaims all warranties, express or implied.
About this Document
Due to developments in the industry, changes in relevant laws, regulations and normative documents, or business development requirements, M-TEC has the right to modify or change the terms of this Agreement. As soon as the contents of this agreement are changed, M-TEC will publish the changed contents of the agreement directly on the website or in the user programmes of M-TEC. This notification shall contain the express reference that the user bindingly agrees to the new version without objection. If a user objects to the new version, the terms of use shall automatically end with immediate effect. If the user continues to use the M-TEC website or the user programme, this shall be deemed as consent to the new version.

Personal Data
M-TEC Energy Systems GmbH (likewise „M-TEC“, „we“, „us“ and „our“) attaches great importance to the protection of personal data, but requires it together with technical data to provide the services necessary for operation.

Both the portal and the E-Smart APP are free and voluntary services from M-TEC. These services also access the data of the M-TEC products, in particular the battery management system of the Energy Butler and the control of the heat pumps. They are also part of the software infrastructure provided by our partner smart1 solutions GmbH and hosted for M-TEC in the EU.

We are guided by the principle of data minimisation and only store personal data that is necessary for service operations. These are
- First name of the customer
- Surname of the customer
- E-mail address of the customer
- Address (street, postcode, country of the customer)
- Mobile phone number of the customer
- Date of birth of the customer
Server log files: The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are Browser type and browser version, operating system used, URL, host name of the accessing computer, time of the server enquiry, IP address. This data cannot be assigned to specific persons. This data is not merged with other data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.
Technical data: All recorded production and consumption data as well as the associated appliance information. The following data is collected during registration by one of our specialist partners in consultation with the M-TEC service team.

Neither M-TEC nor the listed partners are authorised to pass on this information to third parties.
The data is hosted by M-TEC and also on behalf of our partner smart1 solutions GmbH in the EU. The company guarantees that the data is processed in accordance with the standards of the European General Data Protection Regulation (https://smart1.eu/privacy_policy.pdf).
All security updates are carried out within this structure.
In addition, data is stored selectively in the event of a service enquiry in the communication systems required for processing.
The following rights can be asserted in accordance with the European Data Protection Act (GDPR):
– Right to information about your data processed by us
– Right to rectification: You have the right to obtain from us without undue delay the rectification of inaccurate or incomplete personal data concerning you.
– Right to erasure: You can request that we erase your personal data if we process it unlawfully. Please note that there may be reasons that prevent immediate erasure, such as statutory retention obligations.
– The right to restriction of processing exists if you contest the accuracy of the data, the processing is unlawful but you oppose erasure, we no longer need the data for the intended purpose but you require this data for the establishment, exercise or defence of legal claims or you have objected to the processing of your data (from 25 May 2018).
– Right to data portability in a commonly used, machine-readable format to a third party (from 25 May 2018)
– Right to object: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR, as amended.
Assertion of rights: If you wish to assert one of the aforementioned rights against us, please use our contact options. To confirm your identity, we require additional information to confirm your identity. This serves to protect your rights and privacy.
Obligations of the customer / user
The customer is responsible for selecting and managing user names and passwords to protect the data in the portal and the APP. The customer is responsible for both the secure storage and selection of this data.
